The Government of National Capital Territory of Delhi (Amendment) Bill, 2023, will be presented in the Lok Sabha by Union Home Minister Amit Shah on Tuesday. The controversial ordinance that handed the Union government power over services and officer posting in Delhi is intended to be replaced by the bill.
According to the Lok Sabha's order of business for Tuesday, Minister of State for Home Affairs Nityanand Rai will give an explanation of why the National Capital Territory of Delhi (Amendment) Ordinance, 2023, should be passed immediately.
The Lieutenant Governor and the Aam Aadmi Party-led Delhi government are at odds once again over the legislation.
The AAP has referred to the ordinance as a "black law," "illegal," and "unconstitutional." Arvind Kejriwal, the chief minister of Delhi, has traveled the entire nation to mobilize opposition to the ordinance, and the majority of the opposition parties have assured him that they will vote against the measure in Parliament.
MPs have already received a copy of the bill. An examination of the bill's text, which HT has seen, revealed that a controversial clause that was ostensibly intended to reverse the impact of a Supreme Court decision from May 11 that placed the power of Delhi's administration with the elected government has been removed. It proposes to alter the selection process for tribunal heads by giving the LG some new prerogatives.
The Supreme Court constitution bench verdict that gave power of Delhi's bureaucracy to its elected government in subjects other than policing, public order, and land was essentially overturned when the ordinance was enacted on May 19.
Later, on July 20, the Supreme Court sent the appeal challenging the ordinance to a constitution bench of five judges in response to a petition filed by the Delhi government.
