Former Maharashtra minister Nawab Malik has been released on 10 weeks bail  


The Supreme Court granted bail for the leader of the National Congress Party (NCP) and former Maharashtra minister, Nawab Malik, for 10 weeks. The court further ordered the Directorate General of Enforcement (DE) to submit a response within five weeks, after which a response from Malik would be sent in two weeks.

The Supreme Court will re-hear the bail application after 10 weeks. The Court also ordered that the conditions of release be established by the Special Court under the Anti-Money Laundering Act (PMLA).

The family of Nawab Malik has not yet received the order in hand, then they must immediately apply to the magistrate's court to begin the remaining proceedings. If the procedure is not completed due to upcoming holidays, such as National Day and Parsi New Year, the procedure may be delayed and extended into the weekend.

Bombay High Court refused to grant Malik bail under a temporary medical order on July 13.

The bench has said that there is "no compelling reason to grant temporary bail for medical reasons", and therefore refused to comply with its discretion in granting bail. However, the bail for merit has not yet been heard by the High Court.

Malik's Special Leave Application (SLP) indicates that the Supreme Court has ruled that Malik's right to health or life is not restricted or violated in any way. The court made its decision based on Malik's medical reports, which it said did not provide sufficient grounds to grant medical bail.

The Supreme Court also noted that Malik was ill before his arrest in February 2022, according to SLP.

The SLP added that the Supreme Court should have taken into account the applicant's deteriorating health while in police custody. He pointed out that given the age and status of the petitioner, even assuming that conditions existed prior to his arrest, it is clear that despite being hospitalized, the petitioner continues to continue to suffer from life-threatening illnesses.
