Democrats and the Biden campaign denounce the Texas woman's emergency abortion being blocked


The decision by the Texas Supreme Court to temporarily block a pregnant woman, Kate Cox, from obtaining an emergency abortion has elicited strong condemnation from top Democratic leaders and advocacy groups. On Friday, the state's highest court halted a lower court ruling that had initially permitted the emergency abortion for the 31-year-old Kate Cox from the Dallas-Fort Worth area. The intervention by the Texas Supreme Court was prompted by a petition from Republican Texas Attorney General Ken Paxton, who sought the block.

In response to this development, the Center for Reproductive Rights expressed their dismay on Saturday, emphasizing the unacceptable use of Kate Cox's healthcare as a political tool by the State of Texas during her ongoing medical crisis. This legal battle represents a significant test case, especially in the aftermath of the U.S. Supreme Court's overturning of the nationwide constitutional right to abortion last year, empowering states like Texas to enact nearly complete bans.

Hakeem Jeffries, the top Democrat in the House of Representatives, criticized the decision, accusing "MAGA Republicans" in Texas and across the nation of jeopardizing the lives of mothers. "MAGA" is an acronym for former President Donald Trump's slogan, "make America great again."

Kate Cox had sought court authorization for the abortion after her fetus was diagnosed with trisomy 18 on November 27, a genetic abnormality typically resulting in miscarriage, stillbirth, or death soon after birth. At about 20 weeks pregnant, Cox stated in her lawsuit that continuing the pregnancy would necessitate her third caesarean section, jeopardizing her ability to have more children, a desire shared with her husband.

Attorney General Paxton warned that doctors involved in providing the emergency abortion could face prosecution. Texas' abortion ban includes a narrow exception for cases where the mother's life is at risk or to prevent substantial impairment of a major bodily function.

The 2024 campaign for Democratic U.S. President Joe Biden described Cox's situation as "horrifying" and "heartbreaking." Campaign co-chair and Texas Representative Veronica Escobar highlighted the urgent need for life-saving healthcare being subject to legal battles. Democratic U.S. Senator Elizabeth Warren characterized Cox's predicament as "cruel," attributing it directly to the 2022 Supreme Court reversal of the nationwide constitutional right to abortion, for which Trump's nominations to the court were held responsible.
