In an effort to create a uniform civil code, Assam repeals the Muslim Marriage and Divorce Act



In a stride towards fostering a Uniform Civil Code, the Assam Cabinet convened on Friday and decided to annul the Assam Muslim Marriage and Divorce Registration Act, 1935. Consequently, all affairs pertaining to Muslim marriages and divorces would henceforth be governed by the Special Marriages Act.

This pivotal resolution was reached during a Cabinet session presided over by Chief Minister Himanta Biswa Sarma.

Following the meeting, State Minister Jayanta Mallabarua, during a media briefing, hailed the move as a significant stride towards realizing the Uniform Civil Code.

"The Chief Minister has recently articulated our trajectory towards implementing the Uniform Civil Code. In alignment with this journey, a momentous decision has been made. The annulment of the Assam Muslim Marriage & Divorce Registration Act, 1935, under which 94 Muslim registrars are presently operational, was ratified today," articulated Mallabarua.

The Minister elaborated that henceforth, the responsibility of registering Muslim marriages and divorces would be assumed by the District Commissioner and the District Registrar.

Additionally, Mallabarua disclosed that the 94 Muslim registrars, operating under the aforementioned Act, would be relieved of their duties, with each individual receiving a one-time compensation of Rs 2 lakh.

Earlier in the month, Uttarakhand emerged as the inaugural state in the country to pass the Uniform Civil Code Bill. The legislative proposal aims to supplant the antiquated personal laws governing marriage, divorce, succession, and cohabitation.
