Arvind Kejriwal's assistant is detained for four days in the Swati Maliwal assault case



A Delhi court has granted four-day judicial custody to Chief Minister Arvind Kejriwal's aide, Bibhav Kumar, in connection with the alleged assault case involving Swati Maliwal.

Bibhav Kumar, who was arrested on May 18, was initially in police custody for five days before being transferred to judicial custody. His lawyer questioned the necessity of his arrest, citing guidelines from the Arnesh Kumar case, which emphasize that arrests should be exceptional, especially for offenses carrying less than seven years of imprisonment.

The Delhi Police, following court instructions, allowed Bibhav Kumar's family members and lawyer to meet him. However, Bibhav's lawyer argued that both police and judicial custody impinge on his client's freedom.

During the court proceedings, Bibhav's lawyer raised concerns about the duration of judicial custody, suggesting that a 14-day remand was not sought by the police. The police, on the other hand, asserted that the duration of custody was at the discretion of the investigating agency and informed the court that they no longer required Bibhav's police custody.

Consequently, the Tis Hazari court approved the prosecution's request for four-day judicial custody for Bibhav Kumar, extending his detention until May 28.
