Influencer Ashley St. Clair has filed a paternity lawsuit against tech billionaire Elon Musk, seeking sole legal custody of her five-month-old son. The legal petitions, submitted in Manhattan Supreme Court, ask the court to officially recognize Musk as the child’s father and order him to take a genetic test to confirm paternity. St. Clair claims that the child was conceived during a trip to St. Barths in January 2024, and Musk has not publicly acknowledged the baby.
According to the filings, Musk was absent during the child's birth and has only met him three times—twice in Manhattan and once in Texas. St. Clair alleges that Musk has not made any effort to see their son or even request photos. She claims that despite multiple attempts to communicate with Musk regarding the child's well-being, she has received little to no response.
Included in the court documents are text messages purportedly exchanged between St. Clair and Musk. In one instance, after she sent a photo of herself and the newborn, a contact saved as "EM" responded with a brief “All well?” to which St. Clair replied, “He is perfect.” The response from "EM" read, “I look forward to seeing you and him this weekend... Falling asleep. Hope the recovery goes well.” Another message allegedly sent by Musk states, “I want to knock you up again,” after St. Clair shared a picture of herself. When she raised concerns about their lack of communication, he reportedly replied, “Hmm ok... Well, I do have a legion of kids to make.”
St. Clair also revealed that she left the father's name blank on the birth certificate due to security concerns. She referenced Musk’s claim that he receives “credible death threats every day,” implying that naming him on official documents could create unnecessary risks.
The situation has gained significant attention, particularly after Musk indirectly addressed online speculation about the lawsuit. When a social media user accused St. Clair of deliberately orchestrating a plan to "ensnare" him, Musk responded with a single word: "Whoa." In response, St. Clair publicly called on him to address the matter seriously, writing, "Elon, we have been trying to communicate for the past several days, and you have not responded. When are you going to reply to us instead of publicly responding to smears from an individual who just posted photos of me in underwear at 15 years old?"
This legal dispute comes amid Musk’s ongoing custody challenges, including a recent case involving musician Grimes over their three children. His growing number of children and complex relationships have been a topic of public interest for years. As of now, Musk has not issued any direct statements regarding St. Clair’s lawsuit, leaving many questions unanswered about his role in the child’s life and whether he will challenge the claims in court.
