A Kerala BJP politician apologizes for making disparaging remarks on a CPI(M) veteran in 2018

The public apology issued by Kerala BJP leader B Gopalakrishnan to senior CPI(M) leader and former minister PK Sreemathi marks the culmination of a prolonged legal and political battle over defamatory remarks he made against her during a television debate in 2018. The apology, delivered in the presence of Sreemathi and the media, was a result of a legal settlement following a defamation complaint she had filed before the Kannur Judicial First Class Magistrate Court. The case revolved around accusations made by Gopalakrishnan, in which he alleged that Sreemathi was involved in large-scale corruption linked to a company owned by her son and former Home Minister Kodiyeri Balakrishnan’s son. The alleged corruption pertained to the supply of medicines to Government Medical College Hospitals during Sreemathi’s tenure as Health Minister from 2006 to 2011.

Sreemathi had strongly denied these allegations, terming them baseless and defamatory, and pursued legal action against Gopalakrishnan. The BJP leader initially attempted to have the case quashed in the Kerala High Court. However, during the legal proceedings, his lawyer conveyed his willingness to issue a public apology, which led to a mediation process between both parties. The Kerala High Court, in its directive, instructed Gopalakrishnan to issue a public apology, as Sreemathi insisted that any expression of regret must be made openly before the media.

On Thursday, Gopalakrishnan retracted his allegations and expressed remorse over the distress his statements had caused. "I regret the mental distress caused to Sreemathi Teacher. I have no proof to support my allegations," he admitted before the press. Following his apology, both sides agreed to settle the case, with Sreemathi confirming that she would submit an affidavit before the High Court, stating that she had no objection to the defamation complaint being withdrawn.

Despite the legal matter being resolved, the issue did not end there. On Friday, Gopalakrishnan took to Facebook to criticize CPI(M) cadres for allegedly distorting and misrepresenting his apology on social media. In his post, he emphasized that his apology was a voluntary act and not made under pressure. “My apology comes out of my generosity as a public servant and my commitment to uphold dignity in politics. I was not forced by anyone to express regret,” he wrote. He further defended himself by stating that he had merely repeated an accusation that had been made earlier by a late political leader and clarified that he was apologizing because he was unable to substantiate it with concrete evidence.

Gopalakrishnan also disclosed details of his private discussions with Sreemathi, claiming that she had directly conveyed to him that a woman’s dignity was at stake in the matter. He alleged that she was advised by her legal counsel that the case would not stand in court, and therefore, they agreed to settle it through a public apology. He reiterated that his remarks were not intended to defame her but were a repetition of charges that had already been circulated within political circles.

The defamation case stemmed from allegations that Sreemathi’s son was the director of a fraudulent company called Medical Service Corporation and that she had engaged in dishonest financial transactions during her tenure as Health Minister. These claims had been widely discussed in political debates at the time, fueling controversies and sparking criticism from opposition parties. The case gained traction as it involved not only a senior CPI(M) leader but also the political legacy of her family, particularly her son and his alleged business dealings.

While the public apology has officially brought the legal proceedings to a close, the political fallout continues. CPI(M) supporters see Gopalakrishnan’s apology as a significant victory, viewing it as an admission that baseless allegations were leveled against a respected party leader. On the other hand, BJP supporters perceive the apology as a strategic move aimed at closing a contentious legal battle rather than an admission of wrongdoing.

This episode highlights the growing legal and political ramifications of public statements made by political leaders, especially in an era where social media amplifies controversies at an unprecedented scale. In today’s highly charged political climate, defamatory statements, whether made in television debates or online platforms, can have serious legal consequences. The incident also raises questions about the accountability of political leaders in making unverified claims and the potential damage such statements can inflict on individuals, their families, and their public reputations.

Furthermore, it underscores the importance of responsible political discourse, where allegations must be backed by evidence before being made in public forums. The episode serves as a reminder that while political rivalry is inevitable, baseless accusations can lead to legal entanglements, forcing individuals to retract statements or face potential legal penalties. As Kerala's political landscape continues to evolve, such incidents will likely shape future discussions on defamation laws, political accountability, and the role of media in shaping public perception.
